Terms of Use

These Terms of Use form a contract between you and Kaiser Foundation Health Plan of Washington ("we" or "us"), and govern your use of (i) our Kaiser Permanente Member website located at www.ghc.org, and our other websites intended for member or patient use (collectively, our "Websites") and (ii) our mobile applications (the "Mobile Applications"). The Websites and Mobile Applications are referred to collectively in these Terms of Use as the "Site."

The information provided on the Site is not a substitute for the advice of a personal physician or other qualified health care professional. Always seek the advice of a physician or other qualified health care professional with any questions regarding medical symptoms or a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Site.

If you think you or someone you are taking care of has a medical or psychiatric emergency, call 911 or go to the nearest hospital.

BY USING THIS SITE, YOU ACCEPT THESE TERMS OF USE AND AGREE TO ABIDE BY THEM. IF YOU DO NOT AGREE, DO NOT USE THIS SITE.

Scope; third-party content and features: These Terms of Use govern all of the Site. Some features and services within the Site are provided by our third-party service providers, and may be subject to additional and/or different terms and conditions. For example, the Healthwise Knowledgebase and Symptom Checker services are provided by Healthwise, Incorporated ("Healthwise"), our third-party service provider, and your use of those features is subject to Healthwise's Terms of Use. In addition, we may maintain links from the Websites or the Mobile Applications to third-party websites. We do not continuously evaluate, and we are not responsible for, any content on these third-party websites. Your use of third-party websites is governed by any terms of use and/or privacy statements posted on these third-party websites, not by our Terms of Use. The mention of specific products, processes, or services at this Site does not constitute or imply a recommendation or endorsement by us, unless explicitly stated otherwise on our Websites or Mobile Applications.

Modifications: We reserve the right to modify these Terms of Use from time to time by posting an updated version on the Site. Your continued use of the Site after we post an updated version will be subject to the updated Terms of Use.

Personal information; privacy and security: Our collection, use, and sharing of your personal information on the Site is governed by our Privacy Policy. Our treatment of your individually identifiable health information generally, whether or not submitted or accessed by you via the Site, is governed by our HIPAA Privacy Notice. When you use the Site, we take precautions to make the Websites and Mobile Applications secure. For example, we store your individually identifiable health information on servers hosted behind firewalls and use industry standard encryption to protect your information. Members can access certain information (such as immunization records, prescriptions, and appointment reminders) by signing on to the secure member portion of our Site with their Kaiser Permanente member ID number ("UserID")and a unique password, or via the Medical Record Link ("Medical Record Link") in the Mobile Application. When you use the secure member site or the Medical Record Link to view your personal information, your personal health information will be transmitted via a secure channel over the Internet (unless you use an insecure means, such as email, to transmit such information to us).

Permitted use: You may use the secure member site or the Medical Record Link only to access or view personal health information pertaining to you or another person for whom you are legally authorized to make health care decisions. In order to access medical records of a person for whom you have legal authority to make health care decisions, if applicable functionality is available, you must also complete in-person identification verification at a Kaiser Permanente medical offices location or authorized facility and receive a personal UserID prior to accessing the secure member site or the Medical Record Link.  Accessing the Site using another person's UserID is prohibited.  Unauthorized access to the personal health information of another, or disclosure of another's personal health information to any other person, may be a violation of federal or state law, and will be grounds for immediate suspension of your access to the Site.

Restrictions: You agree not to submit any content to the Site that (a) infringes or misappropriates the intellectual property rights or other proprietary rights of any third parties, including their rights of privacy and publicity, (b) contains material that is obscene, illegal, threatening, or defamatory, or (c) contains software viruses, commercial solicitations, political campaigning, or any other form of "spam." You agree not to "frame," resell access to, or distribute any portion of the Site, or to suggest any affiliation between you and us without our separate written permission. Further, you agree not to use or permit the use of any robot, spider, data gathering, scraping or extraction tool or similar mechanism to access or attempt to view or obtain data from the Site, or to interfere or attempt to interfere with the Site or any other user's access to the Site.  Finally, you agree not to reverse engineer, attempt to gain unauthorized access to, or attempt to discover the underlying source code or structure of the Site (including any feature, widget or application made available through the Site).

Online Visits (E-Visits) Kaiser Permanente's Online Visit (E-Visit) service is a digital tool that allows Kaiser Permanente members and Molina members who are paneled with Kaiser Permanente physicians to communicate with and receive certain medical services from Kaiser Permanente providers (the "Online Visit (E-Visit) Service"). The Online Visit (E-Visit) Service is only available for treatment of the non-urgent medical conditions listed here. For advice concerning other symptoms or urgent conditions please call Kaiser Permanente Consulting Nurse Services at 206-901-2244 (in the Seattle area) or 1-800-297-6877. For medical emergencies, call 9-1-1.

THE ONLINE VISIT (E-VISIT) SERVICE IS NOT DESIGNED, INTENDED OR APPROPRIATE TO ADDRESS SERIOUS, EMERGENCY OR LIFE THREATENING MEDICAL CONDITIONS AND SHOULD NOT BE USED IN THOSE CIRCUMSTANCES.

You must be at least 18 years old and a Kaiser Permanente member located in the State of Washington to use the Online Visit (E-Visit) Service. Online Visit (E-Visit) Services are not available for Kaiser Permanente Medicare Advantage members at this time. Online Visit (E-Visit) Services are covered by most Kaiser Permanente medical benefit plans. Please review your benefits booklet or contact the Kaiser Permanente Member Services at 1-888-901-4636 for coverage information. Members on a qualified HSA plan may be required to pay a deductible for Online Visit (E-Visit) Services. If Online Visit (E-Visit) Services are not covered by your medical benefit plan, your use of the Online Visit (E-Visit) Service constitutes your agreement to pay for the service.

The Online Visit (E-Visit) Service is available every day, year round. To use the Online Visit (E-Visit) Service, you will be required to complete a questionnaire that will ask for detailed medical information necessary to diagnose and treat your condition. Within one day after you submit your completed questionnaire, a Kaiser Permanente provider will communicate with you via secure messaging on the Kaiser Permanente secure member website concerning your treatment plan. The Online Visit (E-Visit) Service utilizes information about your condition that is provided by you. Therefore, it is very important that you provide complete and accurate information and that you do not omit any relevant information. Kaiser Permanente will not be responsible for Online Visit (E-Visit) Services provided based on inaccurate, false or incomplete information provided by you. By using the Online Visit (E-Visit) Service you consent to treatment by Kaiser Permanente via the Online Visit (E-Visit) Service.

Use by children: We do not knowingly allow individuals under the age of 13 to submit personally identifiable information to our Site.

You are responsible for security of your account: You are responsible for all use of the Site that occurs under your user account. Since your secure member site or Mobile Application account can be used to access your personal health information, you should take precautions to prevent the disclosure of your password. No Kaiser Permanente personnel will ask for your password in corresponding with you, and you should not share your password with anyone else, even someone who claims to represent us.

Avoid writing down your password or storing it near your computer. If you must commit it to writing, keep it in a secure location away from your computer. We recommend that you change your password on a regular basis. If you suspect that someone else knows your password, change your password immediately. It is your responsibility, once you have accessed your personal health information, not to share that access, or any electronic or written versions of your personal health information, with unauthorized persons. This includes leaving your computer or smartphone unattended while signed on to the Site, and leaving printed or electronic copies in unsecured areas.

Some third-party applications, including, for example, personal health record applications provided by third-parties, request that you provide your UserID and password so that the application can automatically collect medical information about you from your Kaiser Permanente electronic medical record.  It is a violation of these Terms of Use to disclose your UserID and password in connection with such applications.  If you use third-party applications, we recommend reviewing such applications' privacy policies in order to understand how those applications secure your information and how they may use and disclose your information.  Kaiser Permanente does not endorse any third-party personal health record applications.

If you provide your UserID and password to any person or entity, you understand that you are authorizing Kaiser Permanente to disclose any and all information about you that is accessible via the Site, including the Medical Record Link, to the person or entity to whom or to which you provided your UserID and password, and any other party to whom your UserID and password may subsequently be provided by such person or entity, and you agree to indemnify and hold Kaiser Permanente harmless from and against any claims or liabilities that may be brought against Kaiser Permanente arising out of such disclosure.

Additional policies and terms: Your use of the Site is subject to our other terms, conditions, disclaimers, and policies posted on the Site from time to time ("Policies"). You agree to read and comply with any such Policies when you use features and services that we identify as being subject to such Policies.

Copyright and trademark: Except for content that you submit to the Site, the content and information you view on the Site is the property of Kaiser Foundation Health Plan of Washington or our suppliers, and is protected by United States and international copyright laws. You may use this information only for personal use. You may make a single copy of content from the Site for your exclusive, personal use. The compilation of content on the Site is exclusively ours. "Kaiser Foundation Health Plan of Washington," "Kaiser Permanente," "Well Beyond Medicine" and our caduceus logo are our trademarks. You agree not to use our trademarks in connection with any product or service that is not ours, or in any manner that could create confusion about the source of our services.

Termination and suspension: We may suspend, restrict, or terminate your access to the Site, with or without notice, if we have reason to believe that your account on the Site, UserID or Site password has been used by an unauthorized third party for any purpose, or that any information obtained through the use of your account and/or account password has been misused, or that you have violated these Terms of Use, or as we may otherwise deem appropriate. Disclaimers: The information accessible via the Site is not intended as a substitute for medical advice or attention. No content on this Site is intended to replace or amend language for coverage that you may have with Kaiser Foundation Health Plan of Washington or any of its subsidiaries. Though we seek to keep the information and content we provide through the Site as up to date and accurate as possible, we do not guarantee its accuracy, completeness, or appropriateness for any particular purpose. Further, some information and content made available through the Site is provided by our third-party service providers and, though we seek to work with business partners who we believe will provide useful and valuable information to our members, we cannot assume responsibility for third-party content. Accordingly, we disclaim any warranty or representation regarding the completeness, accuracy or appropriateness of any information provided via the Site. Limitation of liability: KAISER FOUNDATION HEALTH PLAN OF WASHINGTON AND ITS AFFILIATES, SUPPLIERS, AND OTHER THIRD PARTIES MENTIONED OR LINKED TO ON THIS SITE ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE, SITE-RELATED SERVICES AND PRODUCTS, CONTENT OR INFORMATION CONTAINED WITHIN THE SITE, AND/OR ANY THIRD-PARTY WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. General: These Terms of Use, together with our Privacy Policy and any Policies (as defined above), are governed by the laws of the State of Washington, as such laws apply to contracts formed within Washington by Washington residents, without regard to its conflict of laws provisions, and form the entire agreement between you and us regarding your use of the Site. The exclusive venue for any action or dispute arising out of these Terms of Use or their violation will be the state and federal courts located in King County, Washington. If we fail to enforce any of these Terms of Use, such failure will not be considered a waiver. Any amendment to these Terms of Use must be in a writing signed by us. These Terms of Use do not confer any rights on any third party.
